Client was a passenger. Client 54 years old. Conditional discharge eligible. Client did not want to deal with probation so he plead guilty to misdemeanor possession charge. Fines and assessments totalling $750.00. No probation.
Client charged with tailgating and careless driving Sparta, NJ.
Potential 7 points on driving abstract. Clients to pled to careless driving 2 points, fine of $239.00. Tailgating charge dismissed. Client advised to take online driver safety course for $35.00 and 2 points will be removed once completed.
DUI case in Randolph.
Client admitted to smoking Marijuana one hour before she drove car to county park. Arrested for DUI being impaired, possession of CDS in motor vehicle, and paraphernalia. Client was examined by a Drug Recognition Expert. Client pled guilty to DUI, loss of Drivers license 7 months. Remaining complaints dismissed.
Civil Jury Trial in Sussex County
The issue was whether my client loaned or gifted a family member $18,000.00 to pay medical bills.
Prior to trial I moved to preclude the judge from instructing the jury with an affirmative defense of duress. The motion in limine was successful. I conducted direct examination on my client and a witness. I cross examined the defendant.
After closing arguments the jury deliberated for an hour and rendered a verdict in favor of my client, 7-1.
Montville Municipal Court; DWI dismissed.
Trooper failed to obtain a warrant to withdraw blood. Trooper failed to obtain valid consent to withdraw blood. Municipal Court denied motion to suppress; Superior Court Appeal reversed municipal court decision.
Sparta Municipal Court; DWI; 90 day loss of license instead of 7 months when the State's discovery was not complete. No mandatory interlock device. 2 day IDRC, Fines and assessments of $800.00; three year $1,000.00 surcharge by insurance company.
Newton Municipal Court; DWI and DWI with minor in vehicle. Motion to suppress was denied. Appeal to Superior Court was denied. Plea to DWI. DWI with child in vehicle dismissed. 7 months loss of drivers license, 2 day IDRC, mandatory interlock when BAC reading .1 or higher; fines and assessments of $800.00. $1,000.00 insurance surcharge for three years.
Sparta Municipal Court: Theft of Cell phone; Plea to a conditional dismissal. One year probation. If no other charges within one year all charges dropped. No criminal record.
Ogdensburg Municipal Court; Driving with suspended license. (Third). Pled to license suspended for failure to pay parking ticket. $100.00 fine plus $33.00 court costs. State could not produce MV proof of mailings.
